Tryon Trading’s International Sales Program has grown over the years. It now includes over 350 International Sales Firms located in over 80 countries. We source our products from 20 manufacturers under contract and another 200 + manufacturers direct or through their USA Agents or Distributors. We are sales driven, and use letters, such as this, to communicate our understandings.

To cover how we handle various transactions, and other matters, we have developed these operating guidelines (terms of sale if you like). They are distributed to each firm that joins our program, and are to be considered as part of each quotation we offer. They are not repeated each time to simplify the quotation procedure.

  1. We normally trade in USD (US Dollars). We usually trade in one of 3 ways:
    1. Cash at/before shipment (means no L/C needed or L/C cost). We bear the risk of cancellation.
    2. L/C - usually irrevocable at sight.
    3. We can/will accept customer orders and pay a compensation (difference between the price the rep sets and our product cost to the rep) after we receive funds from the transaction. [sometimes called INDENT orders] On all such orders, all communications from Tryon Trading is through the Rep firm, and not direct to the customer. On all such orders any deviations in costs other than product may vary the compensation due the rep.
       
  2. In all cases (not usually stated on each quotation), the manufacturers warranty (usually one year on materials and workmanship) forms part of each quotation. If copies or warranties are needed, please ask for same as the situation dictates. Many times the warranty is included in the price sheets we distribute.
     
  3. We assume no responsibility for product liability or damages of any kind for the products we offer for sale. We consider this a manufacturers responsibility. However, we will be glad to assist in the resolution of any problems that may arise.
     
  4. Our mailing address is on our letterhead. Should you have the need to send us courier packages (courier and less than 50 lbs), our street address is as follows:

  5. As a firm in our program, you have access to information, literature, specifications, quotations, and price lists on any of our product lines. As sales develop for a specific manufacturers line, you may want to consider becoming a master distributor for that line. Please review our master distributor program (separate document), and submit your plan for a line if your are interested. The sending of complete product information, pricing and discounts on a line does not indicate that the line has been assigned - it is only a way to communicate more effectively.
     
  6. Should you desire to remit funds by wire transfer, the following information will be helpful:

  7. We use a special quoting log system. Each of your requests is assigned a master control number (Qxxxxx). The same number appears on our quotation, invoice, pro-forma invoice, packing slip (if we generate one), and in correspondence. When contacting us after you know this number, please refer to the Qxxxxx number in all your following correspondence. We file all the papers to the Qxxxxx file, and can find same in less than one minute. Not using the number requires us to do computer cross-reference look-ups that may take hours or days. We, in turn, will always indicate your references in our communications to you.
     
  8. While not stated on each quote, we will consider that all commodities quoted/shipped are for ultimate destination (YOUR COUNTRY), and diversion contrary to USA law is prohibited. Should you plan to re-ship to another country, it will be your responsibility to indicate same at time of quotation and so state on your purchase order.
     
  9. Terms and date of shipment are under the control of our sources and manufacturers. While Tryon Trading will do all it can do to see that they perform as committed, we are not in a position to accept any costs incurred due to delays in shipment or carrier loss, unless agreed to by us in writing as part of our quotation.
     
  10. We will do our best to offer accurate and competitive quotations. Occasionally, an obvious "math error" occurs in one of our quotations. We reserve the right to correct same should a quotation pass into the order stage.
     
  11. We do not recommend APP (Air Parcel Post). We will quote and use it on request, but all such shipments will be paid in advance. The purchaser assumes the risk of any loss. Here is why: In the USA, you can send it registered and the shipment is traceable - but you can not insure it, and if lost the max collectable is USD $ 24.00. If you insure it, the max insurance is $ 500.00 (not insurable in some countries) and it may take 7 - 9 months to collect if lost.
     
  12. It is the responsibility of the buyer to take goods when they are ready for shipment. In most cases, we have assumed the purchase risk when we order the goods based on your order on us. Should delayed acceptance situations occur, we may need to revert to 35% cash with order on future orders, until a more normal business relationship is evident.
     
  13. No one likes canceled orders, regardless of the circumstances. We will do our best to minimize any cancellation charges. But, when they do occur, we expect payment just as on any normal order.
